FinMatch App Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the FinMatch Finance Assistant tool (the “Tool”), including any finance calculator, enquiry form or related features made available on a merchant’s website via FinMatch.
1. Who we are
The Tool is provided by Expressive Consulting Limited t/a FinMatch, a company registered in England and Wales (company number: 10967853).
2. Acceptance of these Terms
By using the Tool (including by entering any information into the calculator or enquiry form), you agree to be bound by these Terms. If you do not agree, you must not use the Tool.
3. What the Tool is for
The Finance Assistant is a marketing and enquiry facilitation tool that allows merchants to display representative finance options to their customers and collect basic contact information so the merchant can follow up with you regarding finance.
FinMatch does not:
• Provide credit
• Make lending decisions
• Offer finance products directly
• Store or process your full credit application
We act only as a facilitator between you and the merchant. Any finance application you choose to proceed with will be handled directly by the merchant and/or the relevant lender (one of our partner lenders).
4. Eligibility
You must be at least 18 years old to use the Tool. By using the Tool you confirm that you meet this requirement.
5. Permitted use
You may use the Tool only for its intended purpose: to view representative finance offers and submit an enquiry to the lender and merchant.
You must not:
• Use the Tool for any unlawful purpose
• Attempt to gain unauthorised access to the Tool, our systems, or any merchant data
• Interfere with, disrupt or damage the Tool or our systems
• Copy, reproduce, modify, distribute or create derivative works of the Tool without our written permission
• Use any automated means (bots, scrapers, etc.) to access or collect data from the Tool
• Submit false, misleading or malicious information
6. Our role and disclaimers
The Tool is provided “as is” and “as available”.
We do not warrant or guarantee:
• That the Tool will be uninterrupted, error-free or secure
• The accuracy, completeness or suitability of any finance offer displayed (these are illustrative only and provided by third-party lenders)
• That any finance offer will be available to you or that you will be accepted for credit
Finance offers shown are representative examples only and your actual rate, terms and eligibility will depend on your personal circumstances and the lender’s assessment.
7. Privacy
Your use of the Tool is also governed by our Privacy Policy, which explains how we collect, use, share and protect any personal information you provide through the Tool.

8. Limitation of liability
To the maximum extent permitted by law:
• We shall not be liable for any indirect, special, incidental or consequential loss or damage arising from your use of the Tool (including loss of profits, opportunity, goodwill or data)
• Our total liability to you (whether in contract, tort or otherwise) shall not exceed £100
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.
9. Intellectual property
The Tool, its design, text, graphics, software and underlying code are owned by FinMatch or our licensors. You are granted a limited, non-transferable, non-sublicensable licence to use the Tool solely for its intended purpose while accessing it.
10. Suspension and termination
We may suspend or terminate your access to the Tool at any time without notice if we reasonably believe you have breached these Terms or for any other legitimate reason.
11. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Tool after changes constitutes acceptance of the new Terms.
12. Governing law and jurisdiction
These Terms are governed by the law of England and Wales. You and we agree to the non-exclusive jurisdiction of the courts of England and Wales.
